Arizona never denied licenses to immigrants

Across the country headlines are reading that the Ninth Circuit court blocked Arizona from denying licenses to immigrants. This is, of course, a lie. The decision of ARIZONA DREAM ACT COALITION V. JANICE BREWER (PDF) blocks the executive order of Jan Brewer ordering the Arizona Department of Transportation not to issue drivers licenses to illegal aliens.

Brewer noted in a response to the Ninth Circuit court ruling that Arizona Revised Statute 28-3153, Subsection D forbids the Arizona Department of Transportation from issuing licenses to anyone who cannot prove they are here in accordance with federal law. Immigrants — who are those here legally applying for citizenship or by other authorized means such as a work visa — can get a license in Arizona. The law forbids issuing licenses to illegal aliens.

The Ninth Circuit Court stated in their decision:

The federal government has enacted a program called “Deferred Action for Childhood Arrivals” (“DACA”), which authorizes certain immigrants who came to the United States as children, without permission, to remain in the United States. In response, Arizona officials — Defendants here — implemented a policy that prevents DACA recipients from obtaining Arizona driver’s licenses.

The “federal government” — so-called by the Ninth Circuit court. They are referring to the national government in Washington D. C. — never enacted such a program. The Department of Homeland Security page on DACA states:

Over the past three years, this Administration has undertaken an unprecedented effort to transform the immigration enforcement system…

The DACA program was started by Executive Order to contravene United States Code. It is not based on law authorized by Congress. On July 2d, 33 Republican lawmakers sent a letter (PDF) to the Obama administration demanding that he stop this program and start deporting illegal aliens.

The reponse of Governor Brewer also read, in part:

In 2012, based on President Obama’s lawless directive, the Department of Homeland Security (DHS) made an administrative policy choice to defer removal proceedings of illegal aliens who were brought to the United States as children, a program referred to as DACA. This policy choice is not federal law authorizing an illegal alien’s presence in the country – it simply is a choice by the executive branch not to enforce deportation proceedings as required under existing federal statute. DHS itself has expressly acknowledged that the DACA Program does not grant any substantive rights and that only Congress can do that.

The DACA Program, the decision to not enforce federal law, has directly led to the massive influx of illegal crossings and the crisis we are witnessing today. If the Ninth Circuit ruling is allowed to stand, the President, as he has already threatened, can contrive a new program refusing to deport the latest arrivals, issue employment authorization cards, and Arizona would have to issue licenses to them as well.

Lawless decrees by the President demonstrate animus to Congress, states and the Constitution. It is outrageous, though not entirely surprising, that the Ninth Circuit Court of Appeals has once again dealt a blow to Arizona’s ability to enforce its laws. With today’s decision, a three judge appellate panel, appointed by Presidents Carter, Clinton and Obama, disregarded judicial precedent and procedure. This continues us down a dangerous path in which the courts and the President – not Congress – make our nation’s laws.

Executive Orders were first issued by President George Washington to explain to cabinet members how to enforce the laws enacted by Congress; not how to circumvent enforcement.

The Constitution give Congress no authority to regulate the issuance of drivers licenses within a State which makes it a Tenth Amendment issue. A law or “order” that violates the Constitution of the United States of America can safely be ignored by States. The policing power of the sovereign States has been established since the Supreme Court decision of Gibbons v. Ogden, 22 U.S. 1 (1824).

The decision would mean that Arizona would have to issue licenses to terrorist group members who have come through the Mexican border illegally and are now waiting for “comprehensive immigration reform.” This is especially troubling since Arizona moved to “real ID” licenses which they claimed they would never do. This will give terrorists groups access to airports and flights.

President Theodore Roosevelt clearly stated: “The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities.” The Elites in both political parties whose objective is to create a New-World Order and remove all national sovereignty, have deliberately avoided securing our Nation’s borders so as to bring about a multilingual, multiethnic, multicultural Tower of Babel. Not loyal to America, no allegiance to our values and principles, with no respect for our traditions and heritage, those running across our borders intend to cash-in on all America has to offer, while remaining loyal to their country of origin.

Historically Italians, Germans, Poles, Swedes, Armenians, Greeks, Jews, and so very many other immigrants chose to come to America to assimilate and proudly become Americans, all the while remembering and celebrating their country of origin. From Asia to Africa, from Latin America to Europe immigrants came to our shores and gladly and proudly sang “God Bless America” and to recite the Pledge of Allegiance. Not today! The flood of illegals pouring into America with the full knowledge and support of the Obama crew are part of the planned destruction of United States sovereignty.

Gov’t Confirms Authenticity of Contract Request for ‘Escort Services for Unaccompanied Alien Children’ at the Border

A recently discovered government request for “escort services for unaccompanied alien children” dating back to January is raising questions about whether the government was planning for a surge of illegal immigrants this year as amnesty talks heated up in the United States.

The request specifically says it was preparing for 65,000 undocumented children.

The U.S. Immigration and Customs Enforcement confirmed the request to TheBlaze, which is for transportation companies to escort children from the U.S.-Mexico border to relocation facilities throughout the United States. The conservative website Weasel Zippers was among the first to notice it.

Texas leaders order “surge” to secure border

texdpsTop Texas officials directed Department of Public Safety troopers late Wednesday to begin a surge to secure the Texas-Mexico border in the wake of a growing number of immigrants flooding into the southern part of the state.

Gov. Rick Perry, Lt. Gov. David Dewhurst and House Speaker Joe Straus signed off on a plan to spend $1.3 million a week to try to combat the problem, even as a group of conservative state lawmakers asked them to call the legislature back to work in a special session to address the situation.

“Texas can’t afford to wait for Washington to act on this crisis and we will not sit idly by while the safety and security of our citizens are threatened,” Perry said in a statement. “Until the federal government recognizes the danger it’s putting our citizens in by its inaction to secure the border, Texas law enforcement must do everything they can to keep our citizens and communities safe.”

Perry, Dewhurst and Straus released a joint letter directing DPS officials to move forward with surge operations through at least the end of the calendar year, using any money allocated for the agency. They noted that previous law enforcement surge operations in the border proved effective.

This came as a number of state legislators asked for a special session to try to find their own solution.

Like a mustang tied to a fence post, many westerners for years have resisted Uncle Sam’s control of land they say more properly belongs to states or counties – or to nobody at all except the ranchers, miners, and loggers who work the land for its natural resources.

The tussle over Cliven Bundy’s 400 cows – grazing on federal land, although he refuses to pay the required fees now amounting to more than $1 million – sharpens this debate, which has featured state legislators, county officials, environmentalists, and federal judges (all of whom have ruled against Mr. Bundy).

In Salt Lake City Friday, representatives from Utah, Idaho, New Mexico, Arizona, Nevada, Wyoming, Oregon, and Washington met for a “Legislative Summit on the Transfer of Public Lands.”

“Those of us who live in the rural areas know how to take care of lands,” Montana state Sen. Jennifer Fielder said at a news conference. “We have to start managing these lands. It’s the right thing to do for our people, for our environment, for our economy and for our freedoms.”

Homeland Security secretary to visit Arizona border

Jeh_Johnson_official_DHS_portrait TUCSON, Ariz. (AP) — The secretary of the U.S. Department of Homeland Security will be visiting border operations in Arizona this week.

Jeh Johnson is expected to visit Douglas and Tucson on Wednesday.

According to his office, he will receive briefings on efforts to secure the border at the Tucson Sector headquarters of U.S. Customs and Border Protection.

Johnson will also meet with state and local law enforcement officials.

Arizona is one stop on a trip that will also include a visit to McAllen, Texas, on Tuesday.

An actor governor for Arizona?

seagalarpaio_thumbIt seems that Arizona is now the target for a possible actor-turned-governor. Fox news reports that Steven Seagal is considering a run for governor of the Great State of Arizona.

The 61-year-old actor told ABC 15 that he has discussed a possible run for governor with Maricopa County Sheriff Joe Arpaio. The “flamboyant actor and martial arts expert” is a member of Arpaio’s Posse.

The actor cites the open border policy of the administration as the biggest problem in the State.

If he were to win, President Obama might have to worry about more than a finger wag.

Fast and Furious gun turns up after Mexican resort shootout


Washington (CNN) — A dramatic shootout between authorities and suspected cartel gunmen at a Mexican seaside resort this month has ties to a botched U.S. gun operation.

A U.S. official said Tuesday that investigators have traced at least one firearm recovered at a December 18 gunfight in Puerto Peñasco, across from the Arizona border, to Operation Fast and Furious.

That’s the disastrous operation run by agents in the Phoenix office of the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Agents allowed suspected gun smugglers to buy about 2,000 firearms with the goal of trying to find and prosecute high-level traffickers. They couldn’t track the firearms and most are believed to have ended up with cartels and gangsters in Mexico.

Many have turned up at crime scenes in Mexico and the United States, including at a shooting that killed a U.S. border agent in 2010.

The shootout in Puerto Peñasco, also called Rocky Point by Arizona tourists, two weeks ago left at least five suspected cartel gunmen dead, including possibly a high level Sinaloa cartel chief, according to Mexican authorities.

Former border agent sentenced for taking bribes

Assistant U.S. Attorney Dominic Lanza said the case was “one of the most serious” Border Patrol corruption cases “in a long time.”

“This is such serious misconduct, such tarnishing of the oath,” Lanza said in asking Rosenblatt to sentence Herrera-Chiang to 15 years in prison.—AZCentral

PHOENIX, Nov. 6 (UPI) — A U.S. judge in Phoenix Wednesday sentenced former Border Patrol agent Ivhan Herrera-Chiang to 15 years in prison for taking bribes to help drug smugglers.

Herrera-Chiang pleaded guilty in April to four felony bribery counts for taking money in exchange for information on border security enforcement, including the combination to locks on U.S.-Mexico border crossing gates, The Arizona Republic reported.

U.S. District Judge Paul Rosenblatt told Herrera-Chiang during sentencing that the ex-border agent had “done about the worst thing a law-enforcement agent could do, especially a Border Patrol agent.”

Homeland agents failed to stop ATF, Fast & Furious guns from crossing border

Fifteen months before the Fast & Furious gun scandal was unmasked in public, Homeland Security agents along the Arizona border recognized that their colleagues at the Bureau of Alcohol, Tobacco, Firearms and Explosives were allowing illegal guns to flow across the border to Mexican drug gangs in violation of federal policy.

The agents working for Homeland’s Immigration and Customs Enforcement agents raised objections internally to their bosses and to their ATF colleagues in late 2009 without success, but did not escalate their concerns to superiors in Washington, according to a new Homeland Security inspector general report that uncovered yet another missed opportunity inside government to stop the bungled gun trafficking investigation.

“Most Homeland Security Investigations personnel in Arizona who received information about the investigation recognized that the task force was using a flawed methodology, which was contrary to ICE policy and practices for weapons smuggling investigations,” the inspector general concluded in a little-noticed report issued late last month.

And the special agent in charge in the case for Homeland failed to appreciate that the flawed tactics in the investigation – allowing weapons to “walk” across the border – violated ICE policies, the report added.
